Object and general disposition
These General Terms and Conditions determine the rights and obligations of the parties in connection with the online sale of products via the website www.araponics.com, owned by Araponics SA.
Araponics is a company specialized in the trade and sale of products intended for the cultivation of plants, especially for the sector of the scientific research. The head office of Araponics is located at Boulevard du Rectorat, 27, 4000 Liège, Belgium. It is registered with the belgian BCE and VAT under the number 0890.381.113.
Araponics reserves the right to modify the present GTC at any time by publishing a new version on its website. The applicable GTC then are those in effectsans on the date of payment (or the first payment in case of multiple payments) of the order.
At each order, the Customer declares to have read all of these Terms and Conditions of Sale and to accept them without restriction or reservation.
Price
The prices of products sold through www.araponics.com are quoted in Euros excluding taxes and shipping charges. When validating the shopping cart, delivery charges are calculated according to the destination encoded by the Customer. These delivery costs are indicative and may be revised upwards or downwards at the time of shipment. If the Customer wishes to obtain the firm price of his order, including delivery costs, he is invited to request a quote. The prices displayed on the quote are then guaranteed as long as the order is confirmed before its expiry.
Customs duties or other local taxes or import duties or state taxes may be payable in certain cases. These duties and taxes are not the responsibility of Araponics. They will be the responsibility of the buyer and are his responsibility (declarations, payment to the competent authorities, etc.).
The Seller invites the buyer to inquire about these aspects with the corresponding local authorities. Araponics reserves the right to change prices at any time.
Delivery
The products are delivered to the delivery address that was indicated when ordering. At the moment the Customer physically possesses the Products, the risk of loss or damage to the products is transferred to him. It is the Customer's responsibility to notify the carrier of any reservations regarding the delivered product. No claim will be accepted beyond 48 hours after receipt of the Products.
Availability
Orders will be processed within the limits of our available stocks or those available from our suppliers. In case of unavailability of an item for a period exceeding 15 working days, the Customer will be immediately notified of the foreseeable delivery times and the order of this article may be canceled on request. The Customer may then request a credit for the amount of the item or its refund.
Payment
Payment is due immediately upon order. The Customer can pay by credit card (Mastercard or Visa) via the secure payment platform PayPal. By giving his bank details at the time of the sale, the Customer authorizes the Seller to debit his card the amount relating to the price indicated. The Customer confirms that he is the legal owner of the card to be debited and that he is legally entitled to use it. In case of error, or inability to debit the card, the Sale is immediately resolved by right and the order canceled.
If the customer wishes to use another method of payment or payement term, he is invited to mention it when requesting a quotation.
Retraction
In accordance with Article VI.47 of the Belgian "Code de droit économique", "Without prejudice to Article VI.53, the consumer has a period of 14 days to withdraw from a distance contract without having to give reasons without incurring costs other than those provided for in Article VI.50 (2) and Article VI.51 ". In case of exercising the right of withdrawal within the aforementioned period, only the price of the purchased product (s) and shipping costs will be refunded, the return costs will be due by the Customer. Returns of products are to be made in their original condition and complete (packaging, accessories, instructions ...) so that they can be remarketed as new.
Intellectual property rights
Trademarks, domain names, products, software, images, videos, texts or more generally any object of intellectual property rights are and remain the exclusive property of the seller. No assignment of intellectual property rights is carried out through these GTC. Any total or partial reproduction, modification or use of these goods for any reason whatsoever is strictly prohibited.
Applicable right
Belgian law applies to this website and this legal notice. In case of dispute, only the courts of Liège are competent.
